In exchange for the opportunity to utilize the indoor golfing facilities at Links 365 in Carson, California, including golf simulators and associated equipment, I agree to this Waiver and Release of Liability (the "Agreement"):

1. Acknowledgment of Risks: I recognize that participating in the activities offered at Links 365, including the use of the facility, golf simulators, and equipment, involves inherent risks that may lead to physical injury, including but not limited to minor injuries, serious injuries, or even death (hereafter referred to as “Risks”). I also understand that inadvertent misuse of the equipment or premises may lead to damages.

2. Release and Indemnification:
I hereby release, discharge, and agree to hold harmless Links 365, its owners, employees, agents, volunteers, and contractors (collectively referred to as "Releasees") from any claims, demands, losses, liabilities, costs, or expenses of any kind (including attorney fees) that may arise out of or be related to the Risks associated with my participation in activities at Links 365, including those arising from the negligent acts or omissions of the Releasees. Furthermore, I acknowledge and consent to the use of photography, videography, and surveillance equipment throughout the Links 365 facility, including but not limited to simulator bays, training areas, and common spaces. I understand that photos or videos may be captured during my participation and used for promotional, advertising, or marketing purposes by Links 365. By signing this waiver, I grant full permission for any such media content to be used, reproduced, or published without compensation or further approval. If I do not consent to the use of my image or likeness for these purposes, I understand that I must submit my objection in writing to Links 365 prior to participating in any activities at the facility.

3. Health Acknowledgment: I certify that I am in good physical health and have no medical condition that would prevent my safe participation in the activities offered by Links 365. I acknowledge that I have not received any advice from a healthcare professional to the contrary.

4. Financial Responsibility: I agree that I am solely responsible for any medical expenses or related costs incurred as a result of any injury sustained while participating in activities at Links 365. This includes any expenses arising from damage to my personal property.

5. Governing Law: This Agreement is governed by and construed in accordance with the laws of the State of California. I agree that if any provision of this Agreement is held to be unenforceable, the remaining provisions will continue to be valid and enforceable.

By signing below, I acknowledge that I have read and understood this Waiver and Release of Liability, and I voluntarily agree to its terms. I am aware that my signature will signify my acceptance of these terms and that I am relinquishing certain legal rights.
